Protocol relating
to an amendment to the Convention
on international Civil Aviation
signe at Montreal on 10 May 1984
 
THE ASSEMBLY OF THE INTERNATIONAL
CIVIL AVIAVTION ORGANIZATION
HAVING MET in its Twenty-fifth Session
Extraordinary at montreal on 10 May 1984
HAVING NOTED that international civil aviation
can greatly help to create and preserve friendship
and understandng among the nations and peoples of
the world, yet its abuse can become a threat to
general security
Having Noted that it is desirable to avoid friction
and to promote that cooperation between nations
and peoples upon which the peace of the world
depens
HAVING NOTED that it is necessary that international
civil aviation may be developed in a safe and
orderly manner
HAVING NOTED that in keeping with elementary
considerations of humanity the safety and the
lives of persons on board civil aircraft must
be assured
HAVING NOTED that in the Convention on
International Civil Aviation done at Chicago
on the seventh day of december 1944 the
contracting States
recognize that every State has complete and -
exclusive sovereignty over the airspace above
its territory
undertake, when issuing regulations for their -
state aircraft, that they will have for the safety
of navigation of civil aircraft and
agree not to use civil aviation for any purpose -
inconsistent with the aims of the Convention
 
HAVING NOTED the resolve of the contracting States
to take appropriate measures designed to prevent
the violation of other Sates' airspace and the use
of civil aviation for purposes inconsistent with
the aims of the Convention and to enhance further
the safety of international civil aviation
HAVING NOTED the general desire of contracting
States to reaffirm the principle of non-use
of weapons against civil aircraft in flight
a- Decides that it is desirable therfore to amen
the Convention on International Civil Aviation
done at Chicago on the seventh day of December
1944
b- APPROVES, in accordance with the provision
of Article 94 (a) of the Convention aforesaid
the following proposed amendment to the said
Convention
Insert after Article 3 a new Article 2 bis
 
Article 3 bis
a- The contracting States recognize that every
State must refrain from resorting to the use of
weapons against civil aircraft in flight and that
in case of intercption, the lives of persons on
board and the safety of aircraft must not be
endangered. This provision shall not be
interpreted as modifying in any way the rights
and obligations of states set forth in the
Charter of the United Nations
b- The contracting States recognize that every
State, in the exercise of its sovereignty
is entitled to require the landing at some
designated airport of a civil aircraft flying
above its territory without authority or if there
are reasonable grounds to conclude that it is
being used for any purpose inconsistent with
the aims of this Convention it may also give
such aircraft any other instructions to put an
end to such violations. For this purpose the
contracting States may resort to any appropriate
means consistent with relevant rules of
international law including the relavant
provisions of this Convention specifically
paragraph(a) of this Article Each contracting
State agrees to publish its regulations in force
regarding the interception of civil aircraft
c- Every civil aircraft shall comply with an
order given in conformity with paragraph
b- of this Article. To this end each
contracting State shall establish all necessary
provisions in its national laws or regulations
to make such compliance mandatory for any civil
aircraft registred in that State or operated by
an operator who has his principal place of
business or permanent residence in that State
Each contracting State shall make any violation
of such application laws or regulations punishable
by severe penalties and shall submit the case
to its competent authorities in accordance
with its laws or regulations
d- Each contracting State shall take appropriate
measures to prohibit the deliberate use of any
civil aircraft registered in that State or
operated by an operator who has his principal
place of business or permanent residence in that
State for any purpose inconsistent with the aims
of this Convention This provision shall not affect
paragraph -a- or derogate from paragraphs -b- and
c - of this article
B- SPECIFIES pursuant to the provision of the said
Article 94 -a- of the said Convention
one hundred and two as the number of contracting
States upon whose ratification the proposed
amendment aforesaid shall come into force and
D- RESOLVES that the secretary general of the
International Civil Aviation Organization draw
up a Protocol in the English French, Russian
and Spanish languages each of which shall be of
equal authenticity, embodying the proposed
amendment above mentioned and the matter
hereinafter appearing
a) The Protocole shall de signed by the president
of the Assembly and its Secretary General
b) The Protocol shall be open to ratification
by any State which has ratified or adhered to
the said convention on International Civil
Aviation
c) The instruments of ratification shall be
deposited with the International Civil Aviation
Organization
d) The Protocol shall come into force in respect
of the states which have ratified it on the date
on which the one hundred and second instrument
of ratification is so deposited
e) The Secretary General shall immediately notify
all contracting States of the date of deposit
of each ratification of the Protocol
f) The secretary General shall notifie all
States parties to the said Convention of the
date on which the Protocol comes into force
g) With respect of any contracting State
ratifying the protocol after the date aforesaid
the protocol shall come into force upon deposit
of its instrument of ratification with the
international Civil Aviation Organization
 
CONSEQUENTLY pursuant to the aforsaid action
of the Assembly
This Protocol has been drawn up by the secretary
general of the Organization
IN WITNESS WHEREOF the President and the Secretary
General of the aforsaid Twenty-fifth Session
Extraordinary of the assembly of the
International Civil Aviation Organization being
authorized thereto by the Assembly sign this
Protocol
 
DONE at Montreal on the 10th day of May of the
year one thousand nine hundred and eighty-four
in a single document in the English, French
Russian and Spanish languages each text being
equally authentic. This Protocol shall remain
deposit in the archives of the International
Civil Aviation Organization and certified
copies thereof shall be transmitted by the
Secretary General of the Organization to all
States parties to the Convention on International
Civil Aviation done at Chicago on the seventh
day of december 1994

L'ASSEMBLEE DE L'ORGANISATION
DE L'AVIATION CIVIL INTERNATIONALE
S'ETANT REUNIE a Montreal le 10 mai 1984 en sa
vignt cinquieme session extraordinaire
AYANT PRIS ACTE que l'aviation civile international
peut grandement aider a creer et a preserver entre
les nations et les peuples du monde l'amitie et la
comprehension alors que tout abus qui en serait
fait peut devenir une menace pour la securite
generale
AYANT PRIS ACTE qu'il est desirable d'eviter toute
mesentente entre les nations et les peuples et
de promouvoir entre eux la cooperation dont depend
la paix du monde
AYANT PRIS ACTE qu'il est necessaire que l'aviation
civile internationale puisse se developper de
maniere sure et ordonnee
AYANT PRIS ACTE que conformememt aux considerations
elementaires d'humanite la securite et la vie des
personnes se trouvent a bord des aeronefs civils
doivent etre assurees
AYANT PRIS ACTE du fait que dans la Convention
relative a l'Aviation civile internationale faite
a Chicago le 7 decembre decembre 1944 les Etats
contractants
reconnaissent que chaque Etat a la souverainete -
complete et exclusive sur l'espace aerien au
dessus de son territoire
s'engagent a tenir dument compte et exclusive -
sur l'espace aerien au dessus de son territoire
conviennent de ne pas employer l'aviation civile -
a des fins incompatibles avec les buts de la
Convention
AYANT PRIS ACTE de la determination des Etats
contractants de prendre des mesures appropriees
visant a empecher la violation de l'espace
aerien des autres Etats et l'utilisation de
l'aviation civile a des incompatibles avec
les buts de la Convention et de renforcer la
securite de l'aviation civile internationale
AYANT PRUS ACTE du desir general des Etats
contractants de reaffirmer le principe du non
recours a l'emploi des armes contre les
aeronefs civils en vol
Decide qu'il est souhaitable d'amender en
consequence la Convention relative a l'Aviation
civile internationale faite a chucago le 7
Decembre 1994
APPOUVE conformement aux dispositions de
l'article 94 alinea a) de la Convention
mentionnee ci-dessus l'amendement ci-apres
qu'il est propose d'apporter a ladite Convention
Inserer apres l'article 3 un nouvel article 3 bis
 
Article 3 bis
a) Les Etats contractants reconnaissent que chaque
Etat doit s'abstenir de recourir a l'emploi des
armes contre les aeronefs civils en vol et qu'ne
cas d'interception la vie des personnes se trouvant
a bord des aeronefs et la securite des aeronefs
ne doivent pas etre mises en danger. Cette
disposition ne saurait etre interpretee comme
modifiant de quelque maniere que ce soit les droits
et obligations des Etats en vertu de la Charte
des Nations Unies
b) Les Etats contractants reconnaissent que chaque
Etat dans l'exercice de sa souverainete est en
droit d'exiger l'atterissage a un aeroport designe
d'un aeronef civil qui sans titre survole son
territoire on s'il y a des motifs raisonnables
de conclure q'il est utilise a des fins
incompatibles avec les buts de la presente
Convention il peut aussi donner a cet aeronef
toutes autres instructions pour mettre fin a ces
violations A cet effet les Etats contractants
peuvent recourir a tous moyens appropries
compatibles avec les regles pertinentes du droit
international y compris les dispositions
pertinentes de la presente Convention
specifiquement l'alinea a) du present article
Chaque Etat contractant convient de publier
des reglements en vigueur pour l'enterception
des aeronefs civils
c) Tout aeronef civil doit respecter un ordre
donne conformement a l'alinea b) du present
article. A cette fin, chaque Etat contractant
prend toutes les mesures necessaires dans ses
lois ou reglements nationaux pour faire obligation
a tout aeronef immatricule dans ledit Etat ou
utilise par un exploitant qui a le siege
principal de son exploitation ou sa residence
permanente dans ledit Etat de se conformer
a cet ordre
Chaque Etat contractant rend toute violance
de ces lois ou reglements applicables passible
de sanctions severes et soumet l'affaire a ses
autorites competentes conformement a son droit
interne
d) Chaque Etat contractant prendra des mesures
appropriees pour interdire l'emploi delibere
de tout aeronef civil immatricule dans ledit
Etat ou utilise par un exploitant qui a le siege
principal de son exploitant ou sa residence
permanente dans ledit Etat a des fins incompatibles
avec les buts de la presente convention. Cette
disposition ne porte pas atteinte a l'alinea
a) et ne deroge pas aux alineas b) et c) du
present article
FIXE conformement a la disposition dudit
article 94..alinea a) de ladite convention a
cent deux le nombre d'Etats contractants
dont la ratification est necessaire a l'entree
en vigueur dudit amendement et
DECIDE que le Secretaire general de l'Organisation
de l'aviation civile internationale etablira
en langues francaise, anglaise, espagnole et
russe, chcune faisant egalement foi un protocole
concernant l'amemdement precite et comprenant les
dispositions c-dessus
a) Le protocole sera signe par le President
et le Secretaire general de l'Assemblee
b) Le protocole sera ouvert a la ratification
de tout Etat qui aura ratifie la Convention
relative a l'aviation civile internationale
ou y aura adhere
c) Les instruments de ratification seront deposes
aupres de l'Organisation de l'Aviation civile
internationale
d) Le protocole entrera en vigueur a l'egard
des Etats qui l'auront ratifie le jour du depot
du cent deuxieme instrument de ratification
e) Le Secretaire general notifiera immediatement
a tous le Etats contractants la date du depot de
chaque instrument de ratification du protocole
f) Le Secretaire general notifie immediatement
a tous les Etats qui sont parties a ladite
Convention la date a laquelle ledit protocole
entrera en vigueur
g) Le protocole entrera en vigueur a l'egard
de tout Etat contractant qui l'aura ratifie
apres la date precitee des que cet Etat aura
depose son instrument de ratification aupres de
l'Organisation de l'aviation civile
internationale
EN CONSEQUENCE conformement a la desicion si
dessus de l'assemblee
Le present protocole a ete etabli par le
Secretaire general de l'organisation
EN FOI DE QUOI le president et le Secretaire
general de la vingt-cinquieme session
extraordinaire de l'assemblee de l'Organisation
de l'aviation civile internationale dument
autorises a cet par l'assemblee ont appose
leur signature au present protocole
FAIT a montreal le 10 mai de l'an mil neuf cent
quatre-vingt-quatre en un seul document dans
les langues francaise, anglaise, espagnole
et russe chacun des textes faisant egalement
foi. Le present protocole sera depose dans
les archives de l'Organisation de l'Aviation
civile internationale et des copies certifiees
conformes seront transmises par le Secretaire
general de l'organisation a tous Les Etats
Parties a la Convention relative a l'aviation
civile internationle faite a Chicago le 7
decembre 1944

بروتوكول بشأن تعديل لاتفاقية الطيران المدني الدولي (المادة 56) موقع عليه في مونتريال في اليوم السادس من اكتوبر 1989


بروتوكول بشان تعديل المادة 56 من اتفاقية الطيران المدين الدولي موقع عليه في مونتريال في اليوم السادس من اكتوبر 1989
ان الجمعية العمومية لمنظمة الطيران المدني الدولي وقد اجتمعت في دورتها السابعة والعشرين وفي مونتريال في اليوم السادس من اكتوبر 1989
واذ احاطت علما بالرغبة العامة للدول المتعاقدة في زيادة عضوية لجنة الملاحة الجوية
واذ رات انه من الملائم زيادة عضوية تلك الهيئة من خمسة عشر الى تسعة عشر عضوا
واذ اعتبرت انه من الضروري تحقيقا للغرض المذكور اعلاه تعديل اتفاقية الطيران المدني الدولي المبرمة في شيكاغو في اليوم السابع من ديسمبر 1944
1- تعتمد وفقا لاحكام المادة 94 (أ) من الاتفاقية المذكورة اعلاه التعديل المقترح التالي للاتقافية المذكورة:
في المادة 56 من الاتفاقية تستبدل عبارة (خمسة عشر عضوا) بعبارة (تسعة عشر عضوا)
2- تحدد ب 108 عدد الدول المتعاقدة التي يلزم تصديقها على التعديل المقترح المذكور اعلاه لكي يصبح نافذا وذلك وفقا لاحكام المادة 94 (أ) من الاتفاقية المذكورة
3- تقرر ان يقوم الامين العام لمنظمة الطيران المدني الدولي باعداد بوتوكول باللغات الانكليزية والفرنسية والروسية والاسبانية بحيث تكون كلها متساوية في الحجية ويتضمن التعديل المقترح المذكور اعلاه والاحكام الواردة ادناه:
أ) يوقع رئيس الجمعية العمومية وامينها العام على البروتوكول
ب) يفتح باب التصديق على البروتوكول من جانب اية دولة تكون قد صدقت على اتفاقية الطيران المدني الدولي المذكورة او تكون قد انضمت اليها
ج) تودع وثائق التصديق لدى منظمة الطيران المدني الدولي
د) يصبح البروتوكول نافذا بالنسبة للدول التي صدقت عليه وذلك في تاريخ ايداع وثيقة التصديق الثامنة بعد المائة
هـ) يقوم الامين العام فورا باخطار جميع الدول المتعاقدة بتاريخ ايداع كل تصديق على البروتوكول
و) يقوم الامين العام فورا باخطار جميع الدول الاطراف في الاتفاقية المذكورة بتاريخ دخول البروتوكول حيز النفاذ
ز) يصبح البروتوكول ساريا بالنسبة لاية دولة متعاقدة تصدق عليه بعد التاريخ المشار اليه اعلاه وذلك اعتبارا من تاريخ ايداع وثيقة تصديقها لدى منظمة الطيران المدني الدولي وبالتالي وبناء على قرار الجمعية العمومية المذكور انفا

قام الامين العام للمنظمة باعداد هذا البروتوكول
اثباتا لما تقدم يوقع رئيس وامين عام الدورة السابعة والعشرين للجمعية العمومية لمنظمة الطيران المدني الدولي على هذا البروتوكول بناء على السلطة المخولة لهما من الجمعية العمومية

حرر في مونتريال في اليوم السادس من اكتوبر من سنة الف وتسعمائة وتسع وثمانين في وثيقة واحدة باللغات الانكليزية والفرنسية والروسية والاسبانية وحجيتها الرسمية جميعا واحدة. ويظل هذا البروتوكول مودعا في محفوظات منظمة الطيران المدني الدولي, ويقوم الامين العام للمنظمة بارسال نسخ معتمدة منه الى جميع الدول الاطراف في اتفاقية الطيران المدني الدولي المبرمة في شيكاغو في اليوم السابع من ديسمبر 1944

Protocol realting
to an amendment to article 56
of the convention on international civil aviation

THE ASSEMBLY OF THE INTERNATIONAL
CIVIL AVIATION ORGANIZATION
HAVING MET in its Twenty-seventh session at
montreal on 6 october 1989
HAVING NOTED that it is the general desire of
contracting states to enlarge the membership
of the air navigation commission
HAVING CONSIDERED it proper to increase the
membership of that body from ffiteen to nineteen
and
HAVING CONSIDERED it necessary to amend for the
purpose aforsaid the convention on international
civil aviation done at chicago on the senventh
day of december 1944
APPROVES in accordance with the provisions
of article 93 a of the convention aforsaid
the following proposed amendment to the
said Convention
In article 56 of the Convention the expression
fifteen members shall be replaced by nineteen
members
SPECIFIES pursuant to the provisions of the said
article 94a of the said Convention one hundred
and eight as the number of contracting states
upon whose ratification the aforsaid amendment
shall come into force and
RESOLVES that the Secretary general of the
international civil aviation organisation shall
draw up a protocol in the English, French,
Russian and spanish languages each of which
shall be of equal authenticity embodying the
amendement above mentioned and the matters
hereinafter appearing
a) The protocol shall be signed by the President
of the assembly and its secretary general
b) The protocol shall be open to ratification
by any state which has ratified or adhered to
the said convention on international civil
aviation
c) The instruments of ratification shall be
deposited with the international civil aviation
organisation
d) the protocol shall come into force in respect
of the states that have ratified it on date on
wich the one hundred and eight instrument of
ratification is so deposited
e) The..Secretary general shall immediately
notify all contracting states of the date of
deposit of each ratification of the protocol
f) The secretary general shall immediately
notify all states parties to the said convention
of the date on which the protocol comes into
force
g) With respect to any contracting state ratifying
the protocol after the date aforsaid the protocol
shall come into force upon deposit of its
instrument of ratification with the interantional
civil aviation organization
CONSEQUENTLY pursuant to the aforsaid action of
the assembly
This protocol has been drawn up by the secretary
general of the organization
IN WITNESS WHEREOF the president and
the secretary general of the aforsaid Twenty-seventh
session of the assembly of the international civil
aviation organization being authorized thereto by the
assembly sign this protocol
DONE at montreal on the sixth day of october of
the year one thousand nine hundred and eigthy-nine
in a single document in the english , french

s'etant REUNIE a montreal le 6 octobre 1989 en sa
vingt septieme session
AYANT PRIS ACTE du desir general des Etats
contractants d'augmenter le nombre de membres
de la commission de navigation aerienne
AYANT JUGE qu'il convenait de porter de quinze
a dix-neuf le nombre des membres de cet organe
AYANT JUGE necessaire d'amender a cette fin la
convention relative a l'aviation civile
internationale faite a chicago le septieme jour
de decembre 1944
APPROVE conformement aux dispositions de l'alinea
a) de l'article 94 de la convention precitee
le projet suivant d'amendement de ladite
convention:
Remplacer l'expression quinze membres par dix-neuf
dans l'article 56 de la convemtion
Fixe a cent huit le nombre d'etats contractants
dont la ratification est necessaire a l'entree
en vigueur dudit amendement comformement aux
dispositions de l'alinea a) de l'article 94
de ladite convention
DECIDE que le secretaire general de l'organisation
de l'aviation de l'aviation civile internationale
etablira dans les langues francaise anglaise
espagnole et russe chacune faisant egalement
foi, un protocole concernant l'amemdement precite
et comprenant les dispositions ci-dessous
a) Le protocole sera par le president et par le
secretaire general de l'assemblee
b) Il sera soumis a la ratification de tout Etat
contractant qui a ratifie la convention relative
a l'aviation civile internationale ou y a adhere
c) Les instruments de ratification seront deposes
aupres de l'organisation de l'aviation civile
internationale
d) Le protocole entrera en vigueur le jour du
depot du cent huitieme instrument de ratification
a l'egard des etats qui l'auront ratifie
e) Le secretaire general notifiera immediatement
a tous les Etats contractants la date du depot
de chaque instrument de ratification du protocole
f) Le secretaire general notofiera immediatement
a tous les etats parties a ladite convention
la date a laquelle ledit protocole entrera wn
vigueur
g) Le protocole entrera en vigueur a l'egard
de tout etat contractant qui l'aura ratifie apres
la date precitee des que cet etat aura depose
son instrument de ratification aupres de
l'organisation de l'aviation civile internationale
EN CONSEQUENCE conformement a la decision
ci-dessus de l'assemblee
Le present protocole a ete etabli par le
secretaire general de l'organisation
EN FOI DE QUOI le president et le secretaire
generla de la vingt-septieme session de l'assemblee
de l'organisation de l'aviation civile
internationale, dument autorises a cet effet
par l'assemblee ont appose leur signature
protocole
FAIT a montreal le 6 octobre 1989 de l'an mil
neuf cent quatre vingt neuf en un seul document
dans les langues francaise, anglaise
espagnole et russe chacun des textes faisant
egalement foi. Le present protocole dera depose
dans les archives de l'organisation de l'aviation
civile internationale et des copies certifiees
conformes seront transmises par le secretaire
general de l'organisation a tous les etats
parties a la convention relative a l'aviation
civile internationale le faite a chicago

بروتوكول تعديل المادة 50 (أ) من اتفاقية الطيران المدني الدولي موقع عليه في مونتريال في اليوم السادس والعشرين من اكتوبر 1990


ان الجمعية العمومية لمنظمة الطيران المدني الدولي
وقد اجتمعت في دورتها الثامنة والعشرين (الاستثنائية) في مونتريال في اليوم الخامس والعشرين من اكتوبر 1990
واذ لاحظت ان الدول المتعاقدة ترغب بصفة عامة في توسيع عضوية المجلس
واذ رات انه من الملائم زيادة عضوية تلك الهيئة من ثلاثة وثلاثين عضوا الى ستة وثلاثين عضوا
واذ اعتبرت انه من الضروري تحقيقا للغرض المذكور اعلاه تعديل اتفاقية الطيران المدني الدولي المبرمة في شيكاغو في اليوم السابع من ديسمبر 1944
1- تعتمد وفقا لاحكام المادة 94 (أ) من الاتفاقية المذكورة اعلاه, التعديل المقترح التالي للاتفاقية المذكورة:
" في المادة 50 (أ) من الاتفاقية تعدل الجملة الثانية باحلال (ستة وثلاثون محل ثلاثة وثلاثون)
2- تحدد بمائة وثمانية عدد الدول التعاقدة التي يلزم تصديقها على التعديل المقترح المذكور اعلاه لكي يصبح نافذا وذلك وفقا لاحكام المادة 94 (أ) من الاتفاقية المذكورة
3- تقرر ان يقوم الامين العام لمنظمة الطيران المدين الدولي باعداد بروتوكول باللغات الانكليزية والفرنسية والروسية والاسبانية بحيث تكون كلها متساوية في الحجية ويتضمن التعديل المقترح المذكور اعلاه والاحكام الواردة ادناه
أ) يوقع رئيس الجمعية العمومية وامينها العام من البروتوكول
ب) يفتح باب التصديق على البروتوكول من جانب اية دولة تكون قد صدقت على اتفاقية الطيران المدني الدولي المذكورة او تكون قد انضمت اليها
ج) تودع وثائق التصديق لدى منظمة الطيران المدني الدولي
د) يصبح البروتوكول نافذا بالنسبة للدول التي صدقت عليه, وذلك في تاريخ ايداع وثيقة التصديق الثامنة بعد المائة
هـ) يقوم الامين العام فورا باخطار جميع الدول الاطراف في الاتفاقية المذكورة بتاريخ دخول البروتوكول حيز النفاذ
ز) يصبح البروتوكول ساريا بالنسبة لاية دولة متعاقدة تصدق عليه بعد التاريخ المشار اليه اعلاه وذلك اعتبارا من تاريخ ايداع وثيقة تصديقها لدى منظمة الطيران المدني الدولي
وبالتالي وبناء على قرار الجمعية العمومية المذكور انفا
قام الامين العام للمنظمة باعداد هذا البروتوكول اثباتا لما تقدم يوقع رئيس وامين عام الدورة الثامنة والعشرين (الاستثنائية) للجمعية العمومية لمنظمة الطيران المدني الدولي على هذا البروتوكول بناء على السلطة المخولة لهما من الجمعية العمومية

حرر من مونتريال في اليوم السادس والعشرين من اكتوبر من سنة الف وتسعمائة وتسعين في وثيقة واحدة باللغات الانكليزية والفرنسية والروسية والاسبانية وحجيتها الرسمية جميعا واحدة ويظل هذا البروتوكول مودعا في محفوظات منظمة الطيران المدني الدولي, ويقوم الامين العام للمنظمة بارسال نسخ معتمدة منه الى جميع الدول الاطراف في اتفاقية الطيران المدني الدولي المبرمة في شيكاغو في اليوم السابع من ديسمبر 1944

relating to an amendement to article 50 a
of the convetnion on international civil aviation
Signed at montreal on october 1990
 
THE ASSEMBLY OF THE INTERNATIONAL
CIVIL AVIATION ORGANIZATION
HAVING MET in its twenty-eighth Session
Extraordinary at montreal on 25 october 1990
HAVING NOTED that it is the desire of a large
number of contracting states to enlarge the
membership of the concil in order to ensure better
balance by means of an increased representation of
contracting States:
HAVING CONSIDERED it appropriate to increase the
membership of that body from thirty-three to
thirty-six
HAVING CONSIDERED it necessary to amend for the
purpose aforsaid the convention on international
civil aviation done at chicago on the seventh
day of december 1944
APPROVES in accordance with the provisions of
article 94 a of the convention aforsaid the
following proposed amendement to the said convention
In article 50 a of the convention the second
sentence shall be amended by replacing thirty
three by thirty-six
SPECIFIES pursuant to the provisions of the
provisions of the said article 94 a of the said
convention one hundred and eight as the number
of contracting States upon whose ratification the
proposed amendement aforsaid shall come into
force
RESOLVES that the secretary general of the
international civil aviation organization
draw up a protocol in the english, French
Russian an Spanish languages each of which
shall be of equal authenticity embodying the
amendment above mentioned and the matter
hereinafter appearing
a) The protocol shall be signed by the president
of the assembly and its secretary general
b) The Protocol shall be open to ratification
by any state which has ratified or adhered to
the said convention on international civil
aviation
c) The instruments of ratification shall be
deposited with the international civil aviation
organization
d) The protocol shall come into force in respect
of the states which have ratified it on the date
on the which the one hundred and eighth intrument
of ratification is so deposited
e) The Secretary general shall immediately notify
all contracting states of the date of deposit of
each ratification of the protocol
f) The secretary general shall immediately notify
all states parties to the said convention of the
date on which the protocol comes into force
g) With repect to any contracting state ratifying
the protocol after the date aforsaid the protocol
shall come into force upon deposit of its
intrument of ratification with the international
civil aviation organization
CONSEQUENTLY pursuant to the aforsaid action of
the assembly
This Protocol has been drawn up by the secretary
General of the Organization
IN WITNESS WHEREOF the president and the secretary
general of the aforsaid Twenty-eight session
Extraordinary of the assembly of the international
civil aviation organization being authorized
thereto by the assembly sign this protocol
DONE at montreal om the twenty-sixth day of
october of the year one thousand nine hundred
and ninety in a single document in the english
French, Russian and spanish laguages each text
being equally authentic. This Protocol shall
remain deposited in the archives of the
international civil aviation organization and
certified copies thereof shall be transmitted
by the secretary general of the organization
to all states parties to the convention on
international civil aviation done at chicago
on the seventh day of december 1944

S'ETANT REUNIE a montreal le 25 octobre
1990 en sa vingt-huitieme session extraordinaire
AYANT PRIS ACTE du desir d'un grand nombre d'etat
contractants d'augmenter le nombre des membres du
conseil afin d'assurer un meilleur equilibre au
moyen d'une representation plus large des etats
contractants
AYANT JUGE qu'il convenait de porter de trente
trois a trente six le nombre des membres de cet
organe
AYANT JUGE necessaire d'amemder a cette fin la
convention relative a l'aviation international
faite a chicago le septieme jour de decembre 1944
APPROVES en vertu des dispositions de l'alinea 94
de la convention precitee le projet suivant
d'amendement de ladite Convention
Amender la deuxieme phrase de l'alinea a) de
l'article 50 de la convention en remplacant les
mots trente-trois par trente six
FIXE a cent huit le nombre d'Etats contractants
dont la ratification est necessaire a l'entree
en vigueur de l'amendement propose conformement
aux dipositions de l'alinea a) de l'article 94
de ladite convention
DECIDE que le secretaire general de l'organisation
de l'aviation civile internationale etablira
dans les langues francaise, anglaise, espagnole
et russe chacune faisant egalement foi un
protocole concernant l'amendement precite et
comprenant les dispositions ci-dessous
a) Le protocole sera signe par le president et
par le secretaire general de l'assemblee
b) Il sera soumis a la ratification de tout
a ratifie la covention relative a l'aviation
civile internationale ou y adhere
c) Les instruments de ratification seront
deposes aupres de l'organisation de l'aviation

e) Le secretaire general notifiera immediatement

a laquelle ledit protocole entrera en vigueur
g) Le prptocole entrera en vigueur a l'egard de tout
etat contractant qui l'aura ratifie apres la date
precitee des que cet etat aura depose son instrument
de ratification aupres de l'organisation de
l'aviation civile internationale
